"We're not going to stop, we just don't want that to happen again to anyone"

Estela Lebron, mother of Jose Padilla, speaks to the media after a court hearing before the 4th Circuit Court of Appeals in Richmond, Va., Wednesday, October 26, 2011.

On June 12, 2009, in the first court ruling, U.S. District Judge Jeffrey White denied a motion to dismiss an earlier suit. Quoting Alexander Hamilton, the judge wrote "[War] will compel nations the most attached to liberty to resort for repose and security to institutions which have a tendency to destroy their civil and political rights. To be more safe, they at length become willing to run the risk of being less free."
